Many ponder what are positive factors of a healthy relationship. It is difficult to pinpoint at a particular time whenever you are in a healthy relationship or not. Compromise

Independence

IPL Revelry and Cricketing Tragedy – History Repeated!

India got eliminated at the Super Eight level of the T20 World Cup in 2009 leading to public agony. In 2010 exactly the same or the worst happened. Both times the T20 World Cup followed immediately after the 46-day Indian Premier League (IPL) saga.

In a way the IPL is a blessed phenomenon. First time it clicked as it was a novelty. Second time it was away from home and became a novelty in South Africa. Third time lucky, as this time it was coming back to ‘sweet home’. While the revelers cried hoarse and hoarser the cricket lovers got increasingly piqued trying to enjoy whatever ‘cricket’ they got out of it. The revelers get trapped into an illusion of loyalties involving ‘home’ teams, eight franchises being named after major Indian cities, even if it means Mahendra Singh Dhoni (Chennai Super Kings) pitted against Sachin Tendulkar (Mumbai Indians).

All the stars of Team India and others are in IPL. The tournament involves one and half months of continuous pressure play, public appearances, late night parties and traveling throughout India. Team India players tend to tire or get hurt. They cannot take the games lightly as they must help their bosses to get returns from their investments. The dirty big money, the glamour and sleaze, the attention and the media hype make them insensitive to national loyalty and pride. They get ferociously loyal to their ‘clubs’ only and increasingly indifferent to their ‘country’.

In T20 World Cup-2010 Team India skipper Mahendra Singh Dhoni went on making stupendous tactical mistakes and lost all the Super Eight matches. He failed miserably to motivate his team members on or off the field. More ominously he never once admitted his shortcomings and tried to blame the IPL late night parties and continuous traveling.

As in 2009 cricket lovers are agonized this time too, with more devastating impact thanks to the IPL scandal, the three consecutive infuriating losses and the players’ casual attitude.

It had come to such a head that nobody could be believed or taken seriously. The cricket Board and the team selectors lost their credentials with the team coach Gary Kirsten blaming the Team India members squarely for lack of motivation and not being mentally or physically fit. The former star cricketers have been saying precious little as many of them had been gagged with IPL money.

You cannot believe the media either. They had been hyping the IPL tournament with screaming headlines unbridled glamour mongering and unprecedented coverage. Now, with Team India turning the tables for genuine cricket lovers the media had been hyping the aftermath too. They are demanding Dhoni’s head and cutting off some other key players. But they are more likely to forget everything as soon as preparation for IPL-4 begins which promises to be longer than even 46 days with addition of two more teams.

Only genuine cricket lovers feel to avoid a cricketing tragedy fast unfolding the IPL must be scrapped or Team India players must not be allowed to be auctioned by the franchisees for the tournament. If nothing of the above happens IPL duration must be reduced to maximum 15 days and group games should take over round robin matches. What could be the justification of having a round robin of just eight mere clubs and each club playing as many as fourteen games before the semi final round?

Scrapping or banning the IPL would signify the much desired demise of big money influence on Indian cricket.

Gbolahan Salami is a striker with the Shooting Stars football club of Ibadan. The rising profile of the bully striker however suffered some knocks last year when he was slammed with a two match-ban for verbally assaulting his former coach at Sunshine football club- Gbenga Ogunbote. To compound his woes, he got a one year ban recently when Shooting stars were forced to a 1-1 draw by visiting Crown F.C of Ogbomosho in a Premier League fixture played on Sunday 30th January 2011. He allegedly attempted to attack the match referee- Michael Oshei for awarding a late penalty against his club-side.

Junior Osagie

Junior Osagie is a former Enyimba and Super Eagles of Nigeria invitee who was fond of breaking camp rules. The highly talented striker could not fulfill his goal of play professional football abroad due partly to his erratic conduct and the negative influence surrounding his career.

Akpan Bassey

Akpan Bassey is the only goalkeeper in the Nigeria Premier League to be given a one year ban since the inception of the league. He was a member of the Ladan Bosso-led U-20 team that participated at the 2007 FIFA World Cup held in Canada. Though lacking in height, he remains one of the best goalkeeper in the Nigeria Premier League till date. His superlative performance has even earned him invitations to the Super Eagles of Nigeria on several occasions. The Heartland F.C of Owerri shot-stopper had earlier been handed down a $650 fine and a one match ban on the 20th of January 2011 for shoving a referee during a Premier league match against Sunshine F.C of Akure.

One sad trend that can be observed from each of these players, is that they are all gifted and talented, but failure to abide by the rules of the game adversely affected their career. It is a lesson which other aspiring footballers must learn from.

All the batsmen who have made double centuries in ODIs belong to India. Sachin Tendulkar made the first double century of Cricket history in just 147 balls against South Africa. In 2012, Virender Sehwag smashed 219 of just 140 balls against West Indies. Finally, Rohit Sharma’s 209 against Australia was the third double century in the history of the sport.

In the beginning of 2014, India along with Australia and England, proposed a restructuring of the ICC hierarchy. The «Big Three» have now officially become the major stakeholders of the World Cricket. Many boards accepted the proposal due to promises of increased revenue sharing by ICC. On Satellite Television Rebroadcast – Piracy and The Law in Nigeria

The growth in the Direct-to-home (DTH) satellite television industry globally is well documented. Nigeria is certainly one of the countries in which such growth is evident and there are at least four major competing satellite television services providers in the Nigerian market. In addition, there is a small but growing number of satellite television enthusiasts who explore the opportunities available for viewing satellite television transmissions without subscription. Generally, there tends to be widespread misconception among the wider populace that satellite television is automatically equivalent to subscription television in ignorance of the fact that there is quite a considerable amount of free-to-air (FTA) transmission available without subscription. It should also be mentioned, however, that some of the enthusiasts do stray beyond simple FTA television into realms bordering on illegality, depending on the circumstances, with the use of some satellite receivers with modified software to watch encrypted material without subscription.

The issue of legality concerning satellite television broadcast and reception in Nigeria is topical currently in light of litigation before the Nigerian courts involving some of the DTH operators in the market and various other parties, especially some cable television service providers. Typically, the DTH operator has paid top dollar for premium content – a prime example being English Premier League (EPL) football – and wishes to protect its revenue stream by avoiding or preventing its dilution as a result of the activities of those who seek to disseminate the same content independently of the DTH. This is more so especially where the DTH operator has paid for exclusive rights. The dissemination, independent of the DTH operator, is usually by some cable service operators who often will obtain the content by satellite and re-broadcast it via cable to their own customers for a fee. In this respect, the main legal issue is whether those distributing such content independently of the DTH operator have the legal right to do so. The on-going litigation in the Nigerian courts between Hi-Media (operators of HiTV) and CTL (a cable services provider) typifies the scenario painted here.

Evidently, where encrypted satellite signals are obtained from the facilities of a DTH operator with exclusive domestic rights and re-distributed for a fee domestically without the DTH operator’s authorisation or consent, the rebroadcast is most likely an unlawful violation of the intellectual property rights of the DTH operator. However, Nigerian law is not entirely clear on the question of the legality of the rebroadcast of satellite signals within Nigeria where the signals are broadcast from outside the country of reception, by an operator that does not have domestic broadcast rights and, especially, where the signals are transmitted FTA without encryption. This scenario is also unfolding in Nigeria with the recent complaints lodged with Nigerian authorities by some Middle East & North Africa (MENA) DTH operators, especially Orbit Showtime about the rebroadcast of their signals by some cable service operators in Nigeria. In fact, the question of re-broadcasting of FTA signals is a constant issue of controversy and legal uncertainty in other countries particularly in Europe. For example, there was a recent crack-down in Spain on ‘illegal’ broadcasters. However, the crack-down seems to have been focused on operators re-broadcasting encrypted content without authorisation whereas it seems that those operators who re-broadcast FTA signals have largely been able to continue their operations as long as they are legally compliant in other respects such as basic licensing requirements and tax responsibilities.

In respect of the situation in Nigeria, the issues turn ultimately on questions of interpretation and application of Nigerian common law and a number of Nigerian legislation including the Copyright Act as amended. It is evidently very likely that the courts will rule that the domestic rights holder of particular content (exclusive rights in the case of EPL football) is able to challenge and restrain any rebroadcast of its own signals without its content or authorisation. It is a different matter if transmission signal for that same content has been obtained from a different source. e.g. a foreign broadcaster of EPL football as opposed to the domestic rights holder. Nevertheless, in such a case the domestic rights holder with exclusive rights may be able to successfully rely on the exclusivity of its own rights irrespective of the source from which the re-broadcaster might have obtained the signal. Potentially, the foreign rights holder may also claim for the violation of its own intellectual property rights.

The least clear legal situation concerns the re-broadcasting in Nigeria of FTA content transmitted or originating from a foreign country. From a wider perspective, there have always been at least two views of this situation. Firstly, the view exists that as long as the domestic re-broadcaster has a suitable broadcasting license and is otherwise in compliance with other relevant law, the re-broadcasting of FTA content is acceptable. Some argue that this explains the activities of some operators in some European countries e.g. Spain, Switzerland etc, where the re-broadcasting of signals originating from another country, especially the United Kingdom, is a well known phenomenon. The second view is that the re-broadcasting of FTA content without the authorisation of the (foreign) origin at least should always be illegal if it is not already so. Evidently, the rebroadcast involves taking advantage of the intellectual property of the originator but other considerations are also taken into account such as that the originator might itself be geographically restricted in terms of its broadcasting rights and that advertisements may be targeted at a particular country.

It is thought that the ongoing litigation before the Nigeria courts does not directly touch on the question of the re-broadcasting in Nigeria of FTA signals originating abroad. It is hoped that the Nigerian courts will provide clarification on the matter at the earliest arising opportunity.

The Case Against Using An Autoresponder

I’ve had to put on my best armour today.

Why? Because I’m no doubt gonna get one hell of a backlash from certain people. After all, email marketers are supposed to love autoresponders.

Aren’t they?

Well, hold your horses. Because I’m here to tell you why you should be sending daily emails (as daily broadcasts) as opposed to relying on an autoresponder sequence.

Ready? Let’s get straight into it…

1) You can’t be «current» with an autoresponder

One of the best things about daily email, is that you get to talk about current events.

And when you talk to your prospects about current things that are happening in the world, they’re gonna pay attention.

Want an example? Okay then. When Leicester won the Premier League, it gave me something current to talk about. And it turned out to be one of the most profitable emails I’ve written. I reckon this was just because people could relate to it, as it had only just happened.

TV series’ and films also make for great email fodder. Again, clearly you have to be current when talking about these.

But if you relied on an autoresponder, you couldn’t exactly be «current», could you…

2) You risk «losing» a lot of people because of one email

Look, even I write a poor email once in a while (I know, shock horror, right?!).

But that doesn’t matter. Because I can just make sales the next day with a better email. And that poor email would then be consigned to history.

But if that same email was in an autoresponder sequence, every single person who joined my list in the future would also receive it. Yes, I know you could take it out or change it. But that’s making things harder than they need to be. Sending daily emails is just so less complicated.

3) Autoresponders don’t tend to «pitch» in every single email

Look, I know you can easily make an autoresponder with a sales pitch in every email.

But the fact of the matter is, most autoresponders don’t. Instead, they tend to tell a story that is told over the course of numerous emails, before then pitching a product/service.

Now, listen.

I’m sure this works.

There are certainly guys who do successfully use autoresponders. Andre Chaperon and John McIntyre spring to mind.

But I believe Ben Settle is the best email marketer in the world. And he does daily email. And, yes, he pitches every single day – without having to take anyone through a long-winded story sequence. Clearly, you’re gonna make money faster doing it Ben’s way. And I like fast. I’m sure you do, too.

Anyway, I’m not saying autoresponders are the devil.

Far from it.

In fact, they do have some advantages over daily broadcasts.

But you know what? For me personally, nothing has come even close to beating daily email when it comes to making sales.

And trust me, if you do it right, it’ll be the same for you, too.
